Scope

These terms govern your use of orcustech.dev (the “Site”), the institutional website of Orcus Tech (registered entity, company number, registered address), referred to here as “we” or “us”.

The Site is informational. It does not itself provide a product or a service account. Client engagements, licences to our software and any paid work are governed exclusively by a separate written agreement signed by both parties; nothing on this Site varies, supplements or overrides such an agreement.

By using the Site you accept these terms. If you do not accept them, please do not use the Site.

Permitted Use

You may read the Site, and quote or link to it with attribution, for your own informational or business-evaluation purposes.

You may not:

  • attempt to gain unauthorised access to the Site or any connected system, or probe, scan or test its security;
  • interfere with the Site’s availability, including by imposing an unreasonable automated load on it;
  • reproduce the Site in substance so as to present it, or a derivative of it, as your own or another party’s offering;
  • use our name, wordmark or emblem in a way that suggests endorsement, partnership or affiliation that does not exist;
  • use the Site in breach of applicable law, or to send us unlawful content.

Intellectual Property

The Site’s text, layout, design system, source code, wordmark and ram emblem, together with the names La Brisa OS and Orbit App, are owned by us or used under licence, and are protected by copyright, database, design and trade-mark law as applicable.

No licence is granted by implication. Rights not expressly given in clause 02 are reserved.

No Offer, No Advice, No Warranty

Descriptions of our work and products are indicative summaries provided for evaluation. They are not an offer capable of acceptance, a representation of fitness for any particular purpose, a service-level commitment, or professional, legal, tax or financial advice.

Product capabilities, including regulatory and fiscal features, are described as at the date of publication and may change without notice. Where a description touches a regulated area, you remain responsible for taking your own advice on your obligations.

The Site is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law.

Third-Party Names and References

The Site refers to third-party technologies, standards and schemes — including Stripe and the Spanish VeriFactu invoicing regime — solely to describe what our software does. Those names belong to their respective owners. Such references do not imply any endorsement, certification, sponsorship or partnership, and we do not speak for those parties.

Availability and Changes

We may change, suspend or withdraw the Site or any part of it at any time, and we do not warrant uninterrupted or error-free availability.

We may amend these terms. The version published here at the time you use the Site is the version that applies, and the date above records the last revision. Material changes will be reflected in that date.

External Links

Where the Site links to a third-party resource, that link is offered for convenience. We do not control and are not responsible for external content, and a link is not an endorsement.

Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings, arising out of or in connection with your use of the Site.

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your mandatory statutory rights are unaffected.

Our total aggregate liability arising from the Site is limited to cap amount.

Governing Law and Jurisdiction

These terms and any dispute arising from them are governed by the law of governing law, and the courts of jurisdiction have exclusive jurisdiction. If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory law of your country of residence.
